1) Acceptance of Terms

By accessing or using BestieMe, you agree to be bound by these Terms and all policies referenced here, including our Privacy Policy. If you do not agree, do not use the service.

2) Eligibility & Accounts

• You must be legally able to form a binding contract in your jurisdiction to use BestieMe.
• Provide accurate information and keep your login credentials confidential. You are responsible for all activity under your account.
• We may verify email/identity where appropriate and may refuse or terminate accounts at our discretion as allowed by law.

3) Your Content & License

• You own the content you post. By posting, you grant BestieMe a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your content solely to operate and improve the service (e.g., show posts to friends, deliver messages, display group/media content).
• You must have the necessary rights to the content you upload.
• We may remove or restrict content that violates these Terms or applicable law.

4) Community Standards

Use BestieMe respectfully. Do not harass, threaten, impersonate, or spam others. Follow group rules and instructions from group owners/admins. Repeated or serious violations may lead to account action under Section 8.

5) BestStore Marketplace

Peer-to-peer only. BestieMe is not a party to any transaction in BestStore and does not handle payments, shipping, or dispute resolution.

• Your risk: Purchases and sales are solely your responsibility.
• No liability: BestieMe is not responsible for losses, damages, or scams arising from marketplace activity.
• Fraud reporting: If you submit evidence of a fraudulent seller, we will review and may permanently suspend that account. However, any loss or damage remains your responsibility.

6) Prohibited Content

To protect users and comply with platform requirements (including Google AdSense, Google Firebase policies, and general SEO content standards), you may not upload or distribute:

• Sexual or explicit content, exploitation, or nudity intended for sexual gratification.
• Copyright-infringing or pirated content (e.g., unlicensed movies/music/software).
• Illegal content/activity, threats, harassment, hate speech, or violent extremism.
• Spam, misleading promotions, impersonation, or other fraudulent schemes.

7) Privacy & Data

• We use Google Firebase to store data such as accounts, messages, media, and listings.
• We do not sell your personal data. We may disclose information if required by law, court order, or valid government request.
• Private chats: We do not routinely monitor private chats. In specific cases (serious violations or legal necessity), the site owner may access required chat records via Firebase Console to investigate. In legal circumstances, specific chats may be provided to a court or law enforcement. We do not yet maintain per-message access logs, but plan to implement access logging in the future.

8) Enforcement & Suspension

• We may remove content, restrict features, suspend, or terminate accounts that violate these Terms or applicable law.
• Serious or repeated violations may lead to permanent suspension.
• You may contact us via the Help Center if you believe action was taken in error.

9) Copyright / DMCA

If you believe content infringes your copyrights, please submit a detailed notice via the Help Center or email bestiemehelp@gmail.com including:

• Your contact information.
• Identification of the copyrighted work and the allegedly infringing content (URLs/screenshots).
• A statement that you have a good-faith belief the use is not authorized.
• A statement under penalty of perjury that the information is accurate and that you are the owner or authorized to act on the owner’s behalf.
• Your physical or electronic signature.

10) Disclaimers

BESTIEME IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BESTIEME AND ITS OWNERS, AFFILIATES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12) Indemnification

You agree to defend, indemnify, and hold harmless BestieMe and its owners, affiliates, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the service, your content, or your violation of these Terms or applicable law.

13) Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws principles. Where required by law, disputes will be brought in the state or federal courts located in California, and you consent to their jurisdiction and venue.

14) Changes to These Terms

We may update these Terms from time to time. If changes are significant, we will provide reasonable notice within the app or by email. Your continued use after changes take effect constitutes acceptance of the updated Terms.
